Pursuant to California Vehicle Code
(CVC) 40902, I respectfully submit this Trial By Written Declaration to the
Court. I plead Not Guilty to the charge of CVC 21706.
As required, enclosed is a check for $175 for bail
payment.?Please refund $175 in the event
the court finds me not guilty.
On Jan 19, 2008, I was driving on the northbound of
Highway 280 to work before 8 o’clock in the morning.?There was very little traffic that particular
morning and suddenly I noticed a police car with the lights flashing.?My first thought was the police officer was
in pursuit of another car for a traffic violation.?However, the police car began weaving in out
across some of the lanes.?The police car
had not been in my lane previously and then suddenly was weaving in and out in
front of me.?I slowed down and the
officer gave a waving motion with his hand out of the car window.?I thought the officer wanted me to go around
him for some reason and I proceeded to do so.?
?/span>The police office then turned on
his microphone for me to pull over at the next exit, El Monte Rd.?I complied with the officer’s request and was
cited for a traffic violation.
Office Copper, ID#12345, has not responded to my
request submitted on Feb 27, 2008 for his daily log for the day of Jan 19,
2008.?Previously, I have had no traffic
violations on my driving record over the past 19 years and believe this
incident does not reflect my driving record.?
Thank you for your time and I hope you will determine that I am not
guilty based on my situation.
If
the court finds me guilty, I request a Trial de Novo, and an option to attend
traffic school level one and have the fine reduced.
In addition, please send me the “Decision and Notice of
Decision?(TR-215) by mail.
