MC 101 - Ch 3 (Court Tricks)

Remember these... Day Description Resolution
Request for an Extension (1st time) 40 When you request the court for an extension for the very first time via personal visit or phone call where you will have to speak with a court clerk in person, the clerk may ask you to post bail immediately if the court knows that you are about to contest the ticket. Never mention that you need more time to contest the ticket. Always mention that you need more time to pay the fine.
Plea Not Guilty at Arraignment, and then Request for TBWD 41 - 70 The Judge may not allow TBWD after your plea at an Arraignment. The Judge will just deny your request, and schedule an in-person court trial date for you.
  • First, if your court appearance is OPTIONAL, don't bother to setup an arraignment if you want to contest the ticket.
  • Second, if your court appearance is MANDATORY, then, turn in a written Not Guilty plea to the court house at least 10 days before your arraignment date.
Request for an Extension (2nd time or more) 41 - 90 When you request the court for an extension via personal visit or phone call where you will have to speak with a court clerk in person, the clerk may ask you to write to the Judge to request for it. And, most likely, the Judge will not response back to you before your due date, or not at all. There is not effective solution for this. However, think of a convincing excuse with document supports of doctor's medicine records and letters, your boss letters, plane tickets, and etc. Then, visit the court in person, and show them these documents of proof, and request for an extension again. Give it a try!
Post Bail before TBWD 41 - 90 If you happen to post bail before submitting your TBWD, the court may later treat your posted bail as fine payment. And, they will not accept your TBWD, or traffic school request, or etc.
  1. Avoid posting bail before TBWD. You should always post bail by sending a check along with your TBWD.
  2. If you really have to post bail, use personal check, and on the "Notes" section of the check, write "NOT GUILTY".
