Dissect speeding violation under 65 MPH (CVC 22350) – By Mr. MC

If you receive a speeding ticket for violating the law CVC 22350, you should first understand what this law is about.

California Vehicle Code Section 22350 – Basic Speed Law

No person shall drive a vehicle upon a highway at a speed greater than is reasonable or prudent having due regard for weather, visibility, the traffic on, and the surface and width of, the highway, and in no event at a speed which endangers the safety of persons or property.

Ask yourself these questions:

  1. Were you driving a vehicle ?
  2. Were you driving at or under 65 MPH but above the posted speed limit ?
  3. Was the weather sunny, the sky was clear, and the road was dry ?
  4. Were you tailgating anyone or endangering anyone or property ?
  5. Was the posted speed limit 25 MPH or below ?
  6. Were you at a School Zone, Residential Area, Senior Center, Senior Home Area, and similar ?
  7. Did you admit your guilty to the cop ? (i.e. I was late for work or I was driving at 50 MPH while the speed limit was 35 MPH…
